Terms of Service

1. Agreement
By booking a trek or tour with Travel Himalaya Nepal Pvt. Ltd. ("THN", "we", "us"), you ("Client") agree to these Terms of Service. Please read them carefully before making a booking.
2. Bookings & Payment
- A booking is confirmed upon receipt of a 30% non-refundable deposit.
- The remaining balance is due 14 days before departure.
- Payments are processed securely via Stripe. Accepted methods: Visa, Mastercard, American Express, PayPal, Apple Pay, Google Pay.
- Prices are quoted in USD. Currency conversion is at the rate applied by your card provider at the time of payment.
3. Cancellation by Client
- More than 30 days before departure — deposit forfeited; remaining balance refunded in full.
- 15–30 days before departure — 50% of total cost forfeited.
- Less than 15 days before departure — no refund.
- We strongly recommend comprehensive travel insurance including trip cancellation cover.
4. Cancellation by THN
We reserve the right to cancel a trip due to insufficient group size, safety concerns (severe weather, political instability), or force majeure events. In such cases, we will offer a full refund or alternative dates. We are not liable for additional travel costs (flights, visas) incurred by the Client.
5. Changes to Itinerary
Trek itineraries may be altered due to weather, trail conditions, permit restrictions, or health and safety considerations. Our guides have final authority on route decisions in the field. No refund is given for itinerary changes beyond our control.
6. Client Responsibilities
- Clients must disclose any pre-existing medical conditions before booking.
- A signed health declaration and emergency contact form is required before departure.
- Clients must have valid travel insurance covering emergency evacuation and medical treatment.
- Clients must follow guide instructions at all times, particularly regarding altitude safety.
- Clients are responsible for obtaining valid Nepal visas and any required permits not included in the tour package.
7. Health & Safety
Trekking in the Himalayas involves inherent risks including altitude sickness, difficult terrain, and extreme weather. THN takes every reasonable precaution (certified guides, pulse oximeters, oxygen above 3,500 m), but cannot eliminate all risk. By booking, you acknowledge and accept these risks.
8. Limitation of Liability
To the maximum extent permitted by Nepali law, THN's liability for any claim arising from a booking is limited to the total amount paid for that booking. We are not liable for indirect, incidental, or consequential losses.
9. Travel Insurance
Comprehensive travel insurance is mandatory for all clients. Coverage must include emergency medical treatment and helicopter evacuation. Policy details must be provided to THN before departure.
10. Photography & Media
THN may photograph or film during trips for promotional purposes. If you do not wish to appear in promotional material, please notify us in writing before departure.
11. Responsible Tourism
Clients are expected to respect local customs, environmental regulations, and the Leave No Trace principles. THN reserves the right to remove a client from a trek without refund for behaviour that endangers others or violates park regulations.
12. Governing Law
These Terms are governed by the laws of Nepal. Any disputes shall be subject to the exclusive jurisdiction of the courts of Pokhara, Nepal.
